1. Acceptance of Terms

By accessing, browsing, or using the Trusted Business Awards website (“Platform”), creating an account, or submitting an application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must discontinue use of the Platform immediately. These Terms constitute a legally binding agreement between you and Trusted Business Awards (“we,” “our,” or “us”).

2. Eligibility

To use our Platform and apply for a distinction, you must be at least 18 years of age and possess the legal authority to enter into binding agreements. If you are applying on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms. Our services are available to businesses, professionals, and freelancers worldwide, regardless of geographic location.

3. Account Registration

When you create an account, you agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information to keep it accurate
Maintain the confidentiality of your password and account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account or any other breach of security

4. Application & Evaluation Process

By submitting an application, you acknowledge and agree that:

Submitting an application is complimentary and does not guarantee approval or receipt of any distinction
All information provided in your application is truthful, accurate, and not misleading
Our review team evaluates applications against category-specific criteria at their sole discretion
Evaluation decisions are final and not subject to appeal, though you may reapply in subsequent periods
We reserve the right to request additional documentation or evidence to verify claims made in your application
Submitting false, fraudulent, or misleading information may result in immediate disqualification, revocation of any issued credential, and potential legal action

5. Credentials, Badges & Verification

Upon approval and payment of the applicable verification fee:

You will receive a verified digital credential (badge) with embeddable code and a dedicated verification page
You are granted a non-exclusive, non-transferable, revocable licence to display the badge on your website and marketing materials for the duration of your active credential period
You may not alter, modify, or misrepresent the badge or its associated verification in any way
You may not sublicence, transfer, or assign the badge to any other party
The badge remains the intellectual property of Trusted Business Awards at all times

We reserve the right to revoke any credential at any time if we determine that the recipient no longer meets our standards, has engaged in misconduct, or has violated these Terms.

6. Fees, Payments & Refunds

Application submission is complimentary. A one-time verification fee is payable only upon approval and when you elect to claim your credential.
All fees are denominated in United States Dollars (USD) unless otherwise specified.
Payments are processed securely through PayPal. You agree to PayPal’s terms of service when making a payment.
All credentials are lifetime awards with no recurring fees. Your badge, verification portal, and directory listing remain active permanently.
All fees are non-refundable once the credential has been issued and the badge delivered, except where required by applicable consumer protection law.

We reserve the right to modify our pricing at any time. Changes will not affect fees already paid.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, badge designs, icons, images, software, and underlying code, is the property of Trusted Business Awards or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Platform without our prior written consent.

8. User Content & Submissions

By submitting content to the Platform (including application materials, logos, testimonials, and business descriptions), you grant us a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and distribute such content solely in connection with operating and promoting our services, your verification page, and our winners directory. You represent and warrant that you own or have the necessary rights and permissions to submit such content, and that it does not infringe upon any third party’s intellectual property rights.

9. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful or fraudulent purpose
Submit false, misleading, or fabricated information in any application
Impersonate any person or entity, or misrepresent your affiliation
Attempt to gain unauthorized access to any part of the Platform
Interfere with or disrupt the integrity or performance of the Platform
Use automated systems (bots, scrapers) to access the Platform without permission
Display or use our badges or credentials in a manner that is misleading, defamatory, or harmful to our reputation

10. Limitation of Liability

To the fullest extent permitted by applicable law, Trusted Business Awards, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or services, including but not limited to loss of profits, revenue, data, or business opportunities. Our total aggregate liability for any claims arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Platform and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Indemnification

You agree to indemnify, defend, and hold harmless Trusted Business Awards and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Platform, your application content, or your infringement of any third party’s rights.

13. Termination

We may suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately, and any active credentials may be revoked. Provisions of these Terms that by their nature should survive termination shall remain in effect.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with applicable international commercial laws. Any disputes arising out of or in connection with these Terms shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration body, unless otherwise required by your local consumer protection laws. Nothing in these Terms limits your statutory rights as a consumer in your jurisdiction.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on this page with an updated effective date.
